We invite all users to read the Terms in their entirety before using these services. The following conditions are binding.

The site www.giochistarter.it is managed by Inmedia Srl, located in Rome (Italy), Via Igino Giordani 18, Roma. VAT number IT09252221008. 

Registration and conduct
The User’s registration allows access to our sites: www.giochix.it (publishing site) and www.giochistarter.it (shop and crowdfunding website). The registration entails the acceptance of the Terms indicated below and the Privacy conditions. Inmedia Srl reserves the discretion to modify, add, or cancel any part of these conditions at any time, informing the users by updating the modifies on the site or by e-mail. Each User must periodically consult these conditions to make sure of any possible change. In each case, the effective use of the Site and the Services counts as acceptance of possible changes that occurred in the meantime. The User can cancel his registration using the Account Cancel button on the Account page.

Users who exploit our services must display a constantly correct behavior with care and loyalty. This is also for using the internet and its services in a more aware and safe way. Indeed, users are responsible for all the activities they created by Portal Services. In particular, the users undertook to align themselves with the major antispam’s organization's advised policies, following the laws in force. 

Newsletter. During the registration phase (and every time at a later stage) by the User’s profile page, it is possible to activate (or deactivate) the Newsletter’s send option. If activated, the user will occasionally receive an informative e-mail about new products and the current business offers. 

Contents
The site’s services allow the User to send and load some content on the Site. The User keeps his/her possible intellectual property rights on these Contents but grants to Inmedia Srl the world licensed to use these Contents to promote and improve its services and develop new ones. If the User cancels his/her Registration, this license remains valid. In the wider law boundaries delimitations, the User takes charge of Contents he/she loads on the site. 

Description of Services
Giochistarter.it is a crowdfunding, crowdpreording, and auctions website (projects) and a shop online platform dedicated to games. For projects, the site puts in contact who wants to publish/sell an unpublished game with the Giochistarter’s users community: it is possible to know the details related to unpublished games, download the rulebooks, watch the temporary contents, and eventually preorder them before their effective publishing. It is also possible to present an unpublished game project to sell it in preview (directly on the site and after the publishing). 
For the shop online, the platform allows users to buy games online.

Projects: Conditions for Users who participate 
There are different types of projects: crowdfunding, crowdpreordering, and auction projects.

When a User participates in a project by buying a game proposed on the site (that is defined as “reward”) there is a pledge between him and the person who proposed the project (Project Responsible or Project Manager). The Inmedia Srl Company manages the www.giochistarter.it portal is not related to this pledge and only facilitates the pledge between the parties. 

The User who participates in a Project declares to have received the following information comprehensively, all contained in the published Project webpage: 

- The identity of the project’s Manager (name or business name, address, VAT number, or equivalent fiscal code).
- Features of the project.
- For crowdfunding projects: minimal money amount is intended to be collected by the Manager (“objective”).
- For auction projects: "buy it" amount
- Duration or time limit of the project (“deadline”).
- Specifications about the product offered (“rewards”).
- The game’s price.
- All taxes and possible shipping fees.
- The ways of payment, shipping, and other forms of contract implementation.
According to article 44, comma 2 of Consumer’s Code, the possible right of withdrawal or exclusion, and ways for restitution or retirement timetable. 

The User also declares to have understood the following:

- On Giochistarter is possible to purchase games as a preorder (crowdfunding, crowdpreordering, preorder projects) or as an auction. The User exclusively matures the right to receive the game promised by the project/auction Manager by buying a game. This game is the merchandise. The User does NOT acquire any property rights or another real right on the sustained project, and sharing rights or business exploit of the project, any intellectual property right, on the brand, on the license, on future developments of the project. 
- For crowdfunding and crowdpreordering projects, generally, users can cancel their preorders and obtain a full refund within 15 days from the order date: Refer to the project description for any info about this topic.
- For auctions, users can cancel their bid and obtain a full refund only within the campaign end. After that period, the bid/preorder is considered binding.
- For preorders, users can cancel their order and obtain a full refund only if requested within 7 days from the date of availability of the product ordered. Excluding these periods, the bid/preorder is considered binding. Refund doesn't include transaction costs, like Paypal or credit card fees. The user can anyway contact the Project manager for further requests. 
- The User does not sustain any further cost compared to the deposited money (that usually includes the eventual shipping fees). 
- The User has the right to withdrawal from the Contract following the regulations of the Consumer’s Code. Each request concerning the Manager’s duties and the supporter User’s rights based on Consumer’s Code will be directly addressed to the Manager. All the contractual documentation concerning the relationship will be stored in digital support by the Manager. The supporter User’s data, sent to the Manager through digital support at the end of the contract, can be modified or updated by mail to the Manager.
- The sum collected by each project at the end of the campaign is calculated, including all paid orders by users and all confirmed preorders by shops. This amount must be considered final and will not change after the campaign end. 
- Any discount, promotional code, or any form of a bonus coming from the platform (like, for example, the Fidelity or Supporter programs) can be changed or canceled at any time at Giochistarter/Inmedia Srl discretion. Discounts and coupons can’t be used for auctions.

Projects: Additional conditions for the Project’s Managers
The Project Manager accepts:

- To relieve since now Inmedia Srl from any responsibility caused by any action or carelessness related to his/her project.
- To carefully verify his right to publish on giochistarter the contents used and to own all intellectual property rights about them when required. This includes copyright, similar rights of performing artists and photographic and videographic producers, brand rights, patents, commercial names (including Internet domain names and email address names), copyrights, moral rights, rights for all models, database rights, and expertise whether registered or not or which could be registered or not, in all parts of the world.
- To carefully verify the feasibility and economic sustainability of his/her Project and address every perceived found (net receipts) exclusively to the realization of the Project or for the selling of a good and to operate in a lawful way for the best execution of what has been planned. 
- The obligation to procure the Reward to the Users in qualities and characteristics not inferior to the Project’s proposal.
- The obligation to fulfill the processing of personal data for each supporter User in conformity to the former legislation.
- The Giochistarter platform exclusively represents a linking tool between the User’s offer and the Manager’s Project. Therefore, no sort of relationship can be created between Inmedia Srl and the supporter Users, consequently to the offer. In the same way, no sort of relationship can be created between Inmedia Srl and the Managers, consequently the Projects’ publishing. Managers are totally responsible for them. 
- The order can be paid through credit cards, Paypal, and eventually by bank wire transfer and bitcoins.
- For crowdfunding projects, the amounts collected by the projects are effectively transferred to the Project Manager only if the project reaches the sum defined as “objective”. This will usually happen within 30 days from the project end by wire transfer for money collected by credit cards (Mangopay) and by Paypal for money collected by Paypal. The sum will be the net receipts of Management costs.
- For crowdpreorder, preorder, auction projects, the amount collected will be transferred in any case.
- Management costs are represented by a share of the sum collected by the project and, if any, by a fixed cost due to each transaction. They are defined on the Creation page, Data subsection, and on the linked page. It's possible to ask for additional service, requiring a separate agreement and requiring additional charges (share or fixed amount).
- If the crowdfunding Project will not reach the objective, the Project Manager will stop the project for the following 12 months: it will not be possible to announce another project on any crowdfunding platform or print it. The only exception on this point is trying to make another (successful) crowdfunding campaign over Giochistarter.
- To provide to Inmedia Srl some additional information to avoid any fraud risk to his/her Users and let Mangopay Company authorize credit card processing. Persons must provide a Bank account IBAN and BIC code and a copy of a valid ID card. Companies must provide: Bank account IBAN and BIC code, Certified Articles of Association (Statute) of the Company, Legal Representative ID card (valid), Legal Representative Address, Legal Representative email, Signed Shareholder declaration. This information must be provided using the form on the Profile, Projects section. This information must be provided before the campaign started. To provide directly to Paypal any information required to activate the receipt of money on its own Paypal account, if activated.
- To relieve since now Inmedia Srl in case of any problem related to Manager Paypal account, which stops or suspends the collecting or transfer of money.
- The maximum amount of money a project can collect is 15000 euro for Mangopay and 20000 euro for Paypal.
- The starting objective, the rewards, the Project duration, the PayPal account to receive money, and the deadline cannot be changed since the beginning of the Project unless some exceptional or technical issue will cause the Inmedia Srl team to express an irrevocable decision about it. Anyway, it will be possible to add new stretch goals, new Rewards and change the project description during the campaign.
- The amount of the sum asked by Users is shared out in groups (established by the Project Manager), each corresponding to a reward.
- To accept the Giochistarter Fidelity Program. This program allows the best Users of the platform to gain a discount on crowdfunding/crowdpreordering projects. The Project Manager allows Fidelity User discount for a maximum discount of 10% on the reward price.
- For crowdfunding/crowdpreordering projects to accept a full refund, any User who will ask to cancel his preorder within a minimum of 15 days from the order date. 
- In case the shipments to Users will be managed by Inmedia Srl, to provide games to Inmedia Srl warehouse in Pomezia, Rome, Italy at least 45 days before the required delivery date own cost. Any additional cost due on that shipment (customs charges or VAT) will be charged to the Project Manager.
- Inmedia Srl is not responsible for the interaction among the Project Manager, and the privates and/or companies found on or by the service; this includes the supply of goods and/or services and all other terms, conditions, guarantees, or declarations associated with announces on Giochistarter. These relationships are exclusively entrenched between the Project Manager and these privates/companies.
- Inmedia Srl is not compelled to survey or overview the performances or the punctuality of Projects, and it is not responsible for damages or loss caused by these negotiations. 
- Inmedia Srl is not compelled in possible controversies or debates which can rise among the Users and Project Managers, or among the site’s users and third parts. In case of controversy, Inmedia Srl and its officials, employees, agents are expressively relieved from damages or another type of requests, known or unknown, suspected or not, reserved or not, originated directly and/or indirectly by these controversies. 
- In each case, Inmedia Srl cannot be responsible for actions moved by and/or against a Project Manager. 
- Inmedia Srl reserves the right to cancel or suspend the Project considered not adequate for the site for any reason.
- The Project Managers will lead the rewards procedures of their backers to their personal discretion. Anyway, Inmedia Srl is not responsible for releasing the rewards offered by Project Managers in return for their payment.
- In each case, Inmedia Srl will be totally unrelated (and without any responsibility and duty) for what concerns every fiscal and accounting issue related or attributable to the management of the received income from Project Managers as an offer from Users, and in each case connectible to the potential development of business projects, to the goods transfer, gifts or rewards related to the project.
- The Project Manager who will receive the income collected on Giochistarter will become its exclusive owner. He will have to take charge of the fiscal regularization of the income concerning his/her fiscal contributory position.
- Once the sum collected has been deposited and the User data have been collected, the relationship between Inmedia Srl and the Project Manager will end.
- If the Project Manager runs the project on other external platforms, he will use identical (or better) conditions for GS users. This is specially referred to as rewards and stretch goals applied. 

Projects: Inmedia Srl limitation of responsibility 
Every User and project Manager accepts the following: 
- Inmedia Srl cannot be considered responsible for any service malfunctioning caused, for example, by telephone or electrical lines breaking down and/or other types of online transmissions, such as overloading, interruptions, or any independent cause. 
- In particular, Inmedia Srl cannot be considered responsible for the non-fulfillment of its own duties if circumstances beyond one’s control cause them.
- Inmedia Srl cannot be considered responsible for text, images, video, and any other content shown on a project.
- Inmedia Srl cannot be considered responsible if third parties compromise the effectiveness of the offered service, including the slowdown of speed or the malfunctioning of telephone lines and the computers and servers that manage the online traffic. 
- Inmedia Srl is not responsible for breakdowns or malfunctions of any kind of the site, caused, for example, by fire, explosions, earthquakes, volcanic eruptions, landslips, hurricanes, storms, floods, avalanches, war, insurrections, riots, striker and any other unpredictable cause that hinder the arranged service. 
- In case Inmedia Srl is forced to interrupt the service for unusual events or maintenance, it will try to reactivate it as fast as possible to decrease the inconveniences. Inmedia Srl will define the procedure to access the services and reserve the faculty to improve them at any time to increase their efficiency. 
- Inmedia Srl has no responsibility and/or control over Users who access the site; external contents redirected from the site; any effect caused by Users; interpretation and/or use of contents; the information on the site can be disturbing or inappropriate for somebody. Inmedia Srl does not grant any declaration related to any content accessible through the site and will not be responsible for the accuracy, copyright conformity, loyalty, or decency of the contents created through the Site or the Service.
- The service is offered only considering these conditions, without any type of warranties (expressed or implicit), so it declines any responsibility.
- Inmedia Srl will not be responsible for the e-mail address privacy, the registration and the ID information, space on disk, communications, informal data or business secrets, or any other content memorized by Inmedia Srl and transmitted on the nets accessible from the Site, or connected with the Service.
- The user undertakes to defend and keep Inmedia Srl unharmed, including officials, employees, agents, and other subjects who operate in any way for Inmedia Srl. Same thing for responsibilities, complaints, and expenses, legal actions which can be launched, or related to the use or misuse of the Site, services, and contents or in violation of the terms, or in violation of User, or third parts in the use of any intellectual property or other rights of any person or entity. 
Inmedia Srl can allow linking to other sites or internet resources and other sites or resources that can contain some links addressing the site. When accessing third-party websites, this is done at one’s own risk. These other websites are not under the control of Inmedia Srl. The user recognizes that the company is not responsible for the content, functions, accuracy, loyalty, opportunity, or other features of these sites and resources. The inclusion of any link does not imply any agreement from Inmedia Srl or any form of partnership with its managers. The User agrees that Inmedia Srl will not be directly or indirectly responsible for any damages or losses caused or probably caused by (in connection to) the use or the commitment to these contents, goods, or services, on or through any website or resource. 

Projects: Fees and payments
Access to the service offered on the Giochistarter website is free. A charge is required only to publish a project and to reach the project objective. 

- The rates for the Service depend on the Service chosen. Check the project page for the different services available and the relative charges.
- The User/Project Manager is responsible for paying all taxes and relevant levies concerning the site’s usage. 

Projects: Authority forum
The Italian State laws regulate the service conditions (and possible further norms, politics, or guidelines to integrate into this document) without originating a right conflict. The user declares that for every legal action and/or controversy that can arise or descend from this agreement's application, the territory's authority forum will be uniquely the Courthouse of Rome.

Projects: Resolution Clause
The client recognizes that the non-fulfillment of the duties indicated up here:

- Conditions for Users who participate in a Project
- Conditions for the Project’s Managers
- Inmedia Srl limitation of responsibility
- Fees and payments
- Authority forum 

It will represent the automatic resolution of the agreement, allowing Inmedia to suspend the service and for Inmedia Srl to act against the client for the reimbursement of the major damage. 

Acceptance clauses ex-art. 1341 and 1342 c.c... According to and for the effect of art. 1341 and 1342 c.c. are expressly approved, after being taken into careful consideration, the contents of the following clauses: 

- Conditions for Users who participate in a Project
- Conditions for the Project’s Managers
- Inmedia Srl limitation of responsibility
- Fees and payments
- Authority forum
- Resolution Clause


Shop online
Orders. The orders are manually checked to avoid errors or manipulations. They can be approved or refused. If any payment is missing, that payment is anyway due.

For orders or preorders: 
1) The "available" products are usually delivered within 24-48 hours from the order’s date. 
2) The products indicated as “preorder” or not available are processed only after publishing or their arrival: pay attention. The release date is only suggestive and can change without notice.
3) The products indicated with “on order” are only processed if available among our suppliers.

For projects or auctions: 
(projects) The products, which can represent a project's realization, are processed only after effective publishing. The delivery management is realized by the project’s responsibility: the shipment specifications are shown on the project page. Please check the terms related to projects on the giochistarter website.
(auctions) The auction's responsibility realizes the delivery’s management: the shipment specifications are shown on the auction page. Please check the terms related to auctions on the giochistarter website.

Payments. The Users can pay the products’ price (and the eventual shipping fees) with a credit card or bank wire transfer. Credit card payments can be made on Paypal, Mangopay, or Stripe circuits. Please consult Paypal and Mangopay's terms of use. 

Claims. Claims for transport damage must be sent within 7 days from receipt of the package. After this time, the forwarder company will automatically reject the claims. The game box is not replaceable. Please note that the forwarder company will decide unquestionably whether to accept the complaint and provide the appropriate reimbursement. Claims for lost/not received packages must be made within 120 days from the shipment date.

Errors. If the game failed to arrive because of your mistake (wrong address, recipient absent, not picking up at courier/postal warehouse, etc.), you will have to pay an additional shipping/warehousing cost for us to re-send/re-deliver your game. This cost will also include the return costs of the game. On the other hand, if the error is ours, we will send it again to you at our expense. If the package is lost or destroyed, we will reship it at our expense, only if it is insured. In this case, it will be the customer's responsibility to choose a second shipment, a safer or more reliable method if the first one did not work, and to pay any difference in cost. The choice of non-traceable shipping methods for a second shipment will automatically exonerate us from any responsibility regarding the game's delivery. 

Please note that we will not reship any game without first investigating what happened to the first shipment. This can be processed quickly through the courier service option but may require an additional 1-5 weeks through the postal service. 

Promotions. Any offer or promotion has a limited duration and can be interrupted at any moment without notice. Acquired vouchers, cashback promos, or special bonuses expire after a specific period (see the offer description); in any case, they are no longer valid after 12 months. 

Customs
. Customs taxes may be added if you live outside of the European Community. If this happens, the transporter company could add a cost to the management of Customs. This usually doesn't happen for board games. However, please check your country's rules and regulations. Any additional tax, cost, or additional charge due to Customs will not be our responsibility and will be paid by the customer. There are no exceptions on this point.

Pickup. Generally, the customer can pick up the product at a Fair or at our Shop point. This option, when available, is indicated on the product page. If you chose this option and the game is unavailable at the Fair or you misspick it up, you must change your shipping method to ship it to your address. This is possible by clicking the "Change shipment" button on your order page. In that case, you will have to pay the shipping costs. 

You must collect your orders within 90 days of availability (or at the first available Fair date if you chose Fair pickup). All uncollected orders will have to pay the storage cost of 1 euro/kg of product every 30 days. This cost is not due, if the order is collected within 90 days of product availability (or at the first available Fair date, if you chose Fair pickup). After 24 months from product availability, all non-collected orders will be canceled.

ShipmentsWe ship by postal service or supported courier (UPS, GLS, SDA, DHL, etc.). We reserve the right to separate the contents of orders into different shipments or merge different orders in the same shipment. If this happens, there will not be any additional costs to you as a customer nor the right to any refund.

Please note that the postal service can be slow and may suffer several weeks of additional delay, especially near or during the holidays, like Christmas. This happens very rarely but it is still a possibility and is out of our control. If you would like faster delivery or wish to avoid any risk of a long delay in the arrival of the package, please use a courier service.

Insurance

Courier shipment got basic insurance which protects by package loss and destruction. Insured option for courier service (if available) covers by package damage, but it requires a customer claim when package is delivered to work (ask to postman). Postal service insurance, if available, covers only against package loss or destruction. The game box is not replaceable. In some very rare cases it may happen that a shipment gone lost: in this unlucky case we will refund (or reship) only shipments covered by insurance against loss/destruction. Please remember that any claims for damage must be done within 7 days from receipt of the package, after this time the claims will be automatically rejected by the forwarder company. Please note that the forwarder company will decide unquestionably whether to accept the complaint and to provide the reimbursement they deem appropriate. Claims for packages lost/not received must be done within 120 days from the shipment date.

Tracking

It's possible to track the shipment made by Courier by clicking the Courier logo on order page. Shipments made by the postal service cannot be tracked and, although it happens very rarely (0.1-1% of cases), they can be lost.

Delivery timing

Delivery time in the table above is approximate and not binding. There may be a differences in some countries that are beyond our influence. Postal service delivery timing is often erratic and in some rare case can suffers several weeks of delay.

Troubleshooting

If the shipment fails to arrive and returns back for any reason (wrong address, recipient absent, not picking up at courier/postal warehouse, etc.), you will have to pay an additional shipping/warehousing cost for us to re-send/re-deliver your game. This cost will also include the return costs of the game.
If the package is lost or destroyed, we will reship it at our expense only if it was a courier shipment or a postal insured shipment.
If you live outside of the European Community, custom's taxes may be added. This usually doesn't happen for boardgames; however, please check your country's rules and regulations as this aspect will not be our responsibility.

Recommendation

Please consider that Postal Service can suffer some troubles. We strong suggest to use a courier service.

Available products are shipped usually in 24-48 hours (working days). We reserve the right to separate the contents of order into different shipments or to merge the contents of different orders in the same shipment to improve the shipment's delivery speed and any required logistics management. If this happens, there will not be any additional costs to you as a customer nor right to any refund. If you live outside of the European Community, customs taxes may be added. If this happens, the transporter company could add a cost to the management of Customs. This usually doesn't happen for boardgames. However, please check your country's rules and regulations as this aspect will not be our responsibility.

Shop online: Guarantees 
Canceling. Orders by clinging to the Cancel button on the order page. Orders for available products can be canceled within the product shipment preparation; meanwhile, preorders can be canceled within the date of the product availability and the shipment preparation. 
The consumer shall receive a full refund except if the payment provider applies a fee, like PayPal, which uses a 3-4% fee, while credit card direct payments have no fees (Mangopay or Stripe). If the payment doesn’t allow an automatic refund (like PayPal after six months from the payment date, Satispay after a few days from the payment date, etc.), the user can ask for a refund by bank wire transfer to our contact form. In this case, a cost of 4.95 euros is applied.

Right of withdrawal. We accept the return of games, but only for physical persons bought on our website, excluding those bought by shops, corporations, or companies. Return shipping is entirely in the buyer's charge and must be performed within 15 days from the order’s reception. The address used is Inmedia Srl, Via Igino Giordani 18, 00159 Roma.
Returned games must still be in the cello and their original condition. If they have been opened, we will examine them, and the cost to restore them to their original requirements will be deducted from the refunded amount. If the returned games have been damaged or some parts or components are missing, and it will be impossible to restore them to their original condition, they will be returned to the customer after the new shipping fee. 
They will be stored in our storage for three months, waiting for this additional shipping fee payment. After this period, they will be trashed. 

Payments. The Users can pay the products’ price (and the eventual shipping fees) with a credit card or bank wire transfer. Credit card payments can be made on Paypal, Sumup, Stripe, or Mangopay circuit. Please consult Paypal, Sumup, Stripe, and Mangopay’s terms of use. 


General Protection on Giochix brand products (giochix logo on the box) 
It can rarely happen something is missing (a pawn, a cube, etc.). We apologize for causing this disturbance. We’ll take action to substitute some defective or missing content for free for anybody who asks for it. If you bought the game directly from us, you must open an Assistance Ticket using the contact form available on our website. Please specify the contents that must be replaced. In some cases, we can request pictures to help identify the contents and understand the cause of the defect. If you bought the game from another source, please ask your retailer for the game parts required; your retailer will contact us.
The game box and, more generally, the parts damaged, lost, or consumed during the game’s normal usage will not be replaced. This guarantee doesn’t cover little imperfections, but only components not suitable to play and work up to 2 years from the game release; after this period, we cannot promise any availability of replacement parts.
